Fraudulent Broker with massive Malpractices

Dear Sir/Madam, Re: ROInvesting.com, also trading as GMO Trading (Both trading names of Royal Forex Limited) Address: City Home 81, 3rd Floor, 128-130 Limassol Avenue, 2015 Strovolos, Nicosia, Cyprus. From 4th May to 12th June 2020, I fell victim to an organization involved in malpractices, fraud and scam and representing themselves as a legitimate trading company called ROInvesting.com, also trading as GMO Trading (both trading names of Royal Forex Limited) Registered with FCA here:https://register.fca.org.uk/ShPo_FirmDetailsPage?id=001b000002zyvhhAAA) Background I was of the opinion that I opened a live trading account (Similar to ‘Degiro’ that I requested at the same time) with ROinvesting with the purpose of buying and selling actual shares, and not a CFD account. I didn’t know what CFD was and would not have gone any further after I got the account opening email if I was given the correct information in it. There is no mention of CFD in the account opening email. (See attached – Account opening email) Everywhere before the account opening the company has advertised it as the ‘Live trading account’ they have not mentioned the word CFD. Please see the screenshot (attached) I was then pressured and manipulated into adding the funds to the account by people from ROInvesting and then to put trades by them calling me daily. This could be verified by the number of calls I received from them as could be validated from my phone statement. FCA regulations as above clearly stipulate that for CFDs and CFD-like options sold to retail clients, firms will be required to: Limit leverage to between 30:1 and 2:1. Close out a customer’s position when their funds fall to 50% of the margin needed to maintain their open positions on their CFD account. Provide protections that guarantee a client cannot lose more than the total funds in their CFD account. 4. Stop offering monetary and non-monetary inducements to encourage trading. Provide a standardised risk warning, which requires firms to tell potential customers the percentage of their retail client accounts that make losses. The above highlighted regulations in ‘Red’ (4 out of 5) in my case were broken as detailed below. The 3 employees that were involved in my case are Yosef, Andrey and their manager Sahar who were involved in the scam, fraud and malpractice. 1. Limit leverage to between 30:1 and 2:1 – This regulation was clearly violated as the leverage ROInvesting.com offered to me was 500:1 as they set up the Professional account for me (I don’t even understand what leverage is.. They never explained it to me) (See Appendix 1) 2. Close out a customer’s position when their funds fall to 50% of the margin needed to maintain their open positions on their CFD account – This was violated as the open positions were not closed until the funds fell to 15% and even less. On the last day of trading on 12th June my account was showing only 78 gbp left from gbp 300,000 approx a week ago. I was not even left with 15% margin in my account. 3. Stop offering monetary and non-monetary inducements to encourage trading – A blatant violation with the various level of accounts offered with time bound incentives to open/upgrade the account (pressure to invest (eg time-limited offers)) - They kept offering me higher accounts first a Basic (£190 offer amount for account opening for a normal £500 account), then Gold (£35,000 offer amount for a £50k account) then Platinum (£100k offer amount for a £250k account) then Professional then Islamic (£200k offer amount for a £500k account). All were offered with incentive of a lower deposit even though they are opened with higher deposit amounts. In regards to non- monetary inducements they would send the marketing emails from as many as 6-7 different email id’s and show multiple adverts on facebook to persuade and lead me to trade more and more with them.(See attached) 4. Provide a standardised risk warning, which requires firms to tell potential customers the percentage of their retail client accounts that make losses.- In the account opening email there is no risk warning (See attached) They downplayed the risk of losing money. If it was mentioned in the email I would not have gone ahead and added money to the account. Though it was mentioned on their website that I only realised later on and upon questioning them about it they did not provide any satisfactory response. So basically the company did not advertise/disclosed/was not transparent regarding the statistical data representing the percentage of total client losses at the company. Other malpractices and scamming/fraudulent manipulative activities the company or their 3 staff (Yosef, Andrey and Sahar) I had dealings with have been involved in: 1. The company provided direct investment advice - not utilizing 3rd party recommendations. They were making recommendations for me to take the trades. They recommended to go with oil, then forex (with 70:30 RSI strategy), then indices, specific company shares etc. I was a novice and was relying on them to guide me to place ‘bets’ 2. The company offered investment services/advice not related to real market/exchange data (manufacturing false indicators etc.) I was advised to place trades based on RSI level if it was above 70 and under 30. I realised later on by chance one day that the RSI level would be different for Andrey ‘The Account manager/Trader’ and there was a lag on my trading system. So they were in better advantage to take trades as opposed to me. I requested to set me for VPS service which was part of my account but was never done. (See attached) 3. The company unreasonably restricted my ability to withdraw my funds. They initially allowed some returns to give the impression that my trading has been a success. I made around 15 withdrawal requests. 5 requests were only processed. They encouraged me to then invest more money but when I told Andrey that I wish to withdrew the invested money and trade only with profits, the apparent ‘profit’ started to go down and my original investment also went into minus in a span of a day, my account was left with only 15k. I was then advised by Sahar that to recover my original investment I need to now add more money and that the airports would be opening up and they would buy Oil, prices will be going up and if I don’t invest ‘I would miss out the party’ (exact words). The prices didn’t go up and I lost the final balance in the account. I asked them to call me since through email and there’s no further contact from their side. (Email attached) 4. The company was guaranteeing returns/yields (unrealistic ones) 5. The company offered me bonuses and incentives - which are not allowed to be given as per FCA regulations above. 6. The company did not mention the commission and overnight swaps themselves. I was surprised to see some of the commissions/swaps they were charging. (See emails attached) 7. The company did not read the risk disclosure prior to my deposit(s). 8. The company failed to assess the appropriateness, suitability or compatibility of investment instruments. 9. The company used aggressive selling, pressure tactics and manipulation for making me to invest more and more. Please note that my funds were transferred through coercive means and under false pretences. I have reported this matter to the UK police – please see my report to ActionFraud (Ref: NFRC200603701837) 10. The company violated FCA guidelines regarding CfD’s and similar financial products. The company also violated their own rules and procedures on many occasions - for example, by significantly exceeding the leveraged trading limits. 11. The company failed to ensure that I met the criteria to become a Professional client. They knew that I did not have the appropriate knowledge, resources or experience. After they notified me of my ineligibility by email of 20.5.2020, copy attached, they still gave me Professional client status, to my absolute disadvantage. See Appendix 1. 12. ROinvesting.com along with the parent company Royal Forex Limited and other trading name ‘GMOTrading’ have scammed genuine customers before and has bad reputation on internet which I came to know after the research I did on them post scam. I was advised not to put ‘Stop Loss’ specifically by Yosef and Andrey as they said the trade would come back up at some stage even though the company actively promotes putting the stop loss and take profit as could be confirmed by their marketing email (attached). Since company is liable for the employee actions they should be liable for the losses. 14. Company or their 3 staff as named above did not adhere to Exchange Act Rule 9j-1 of the Dodd Frank Act (https://www.sec.gov/rules/proposed/2010/34-63236.pdf) (applicable in UK too), which is intended to prohibit fraud, manipulation, and deception in connection with the offer, purchase or sale of any security- based swap (CFDs), as well as in connection with the exercise of any right or performance of any obligation under a security-based swap, including the avoidance of such exercise or performance. It makes it unlawful for “any person, directly or indirectly, by the use of any means or instrumentality of interstate commerce or of the mails, or of any facility of any national securities exchange, to effect any transaction in, or to induce or attempt to induce the purchase or sale of, any security-based swap, in connection with which such person engages in any fraudulent, deceptive, or manipulative act or practice, makes any fictitious quotation, or engages in any transaction, practice, or course of business which operates as a fraud or deceit upon any person which happened in my case. Hence I would be taking a legal action against the company directors PAVEL SIABANOV, CHRIST SPANOS, ANDREAS SAMATAS, MARIOS NAZIRIS, GEORGE CHIMONIDIS and the 3 staff named above if my hard earned money is not refunded.

good broker for beginners

I opened a demo account with this broker and am happy with everything. Although I am a beginner in trading, the site has clear navigation, the mobile application is quite fast, and in addition, access to a large number of training materials opens up. Now I'm going through the tutorials and carefully watching the video. Helps a lot
